Terms of Service

Effective Date: April 2026

Thank you for choosing Photos by Rob & Jill Futrell. These terms outline the general policies and expectations for our photography services. By booking a session or event with us, you agree to the terms described below.

Services

Photos by Rob & Jill Futrell provides professional photography services in St. Augustine, Florida and the surrounding Northeast Florida region. Our services include wedding photography, elopement coverage, engagement sessions, family and portrait sessions, and commercial photography. Specific deliverables and coverage details are outlined in each client's individual contract or booking agreement.

Booking & Payment

  • Retainer: A non-refundable retainer (deposit) is required to reserve your date. Your date is not secured until the retainer is received and the contract is signed.
  • Payment schedule: The remaining balance is typically due on or before the date of your session or event, unless otherwise specified in your contract.
  • Accepted payment methods: We accept major credit cards, debit cards, checks, and electronic transfers. Specific payment options are detailed at the time of booking.

Cancellation & Rescheduling

  • Client cancellations: If you need to cancel your session or event, the retainer is non-refundable, as it compensates for the reserved date and turned-away bookings. Any additional payments already made may be refundable depending on the timing and circumstances — please refer to your individual contract for details.
  • Rescheduling: We understand that life happens. We're happy to reschedule your session to a mutually agreeable date, subject to availability. Please provide as much notice as possible.
  • Weather: For outdoor sessions affected by inclement weather, we'll work with you to reschedule at no additional charge. We'll monitor conditions and communicate proactively so you're never left guessing.

Image Delivery & Timeline

We take pride in delivering thoughtfully edited images in a timely manner. Typical turnaround times are:

  • Portrait and engagement sessions: Approximately 2–3 weeks.
  • Weddings and events: Approximately 6–8 weeks.
  • Sneak peeks: A small preview of images is typically shared within 1–2 weeks of your event.

Turnaround times may vary during peak wedding season. We'll keep you informed if your gallery needs a little extra time.

Image Usage & Copyright

  • Copyright: All photographs created by Photos by Rob & Jill Futrell are protected by copyright law. The photographer retains full copyright ownership of all images.
  • Personal use license: Clients receive a personal use license that allows them to print, share, and enjoy their images for non-commercial purposes. This includes sharing on social media, ordering prints for your home, and gifting to family and friends.
  • Commercial use: Any commercial use of images (by vendors, venues, publications, etc.) requires prior written permission.
  • Portfolio and marketing: By booking with us, you grant Photos by Rob & Jill Futrell permission to use select images from your session for portfolio, website, social media, and marketing purposes, unless you have opted out via a written request or your contract includes a model release exclusion.
  • Credit: When sharing images on social media or online, we kindly ask that you credit Photos by Rob & Jill Futrell or tag our accounts. It's not required, but it's always appreciated!

Limitation of Liability

  • Equipment and unforeseen circumstances: While we use professional-grade equipment and maintain backups, in the unlikely event of equipment failure, memory card corruption, or other technical issues beyond our control, our liability is limited to a refund of fees paid for the affected portion of the service.
  • Force majeure: Neither party shall be liable for failure to perform due to circumstances beyond their reasonable control, including but not limited to natural disasters, severe weather, pandemic restrictions, venue closures, or government orders.
  • Maximum liability: In all cases, our total liability shall not exceed the total amount paid by the client for the specific service in question.

Governing Law

These terms of service are governed by and construed in accordance with the laws of the State of Florida. Any disputes arising from these terms or our services shall be resolved in the courts of St. Johns County, Florida.

Changes to These Terms

We may update these terms from time to time. Changes will be posted on this page with a revised effective date. Existing contracts and booking agreements remain governed by the terms in effect at the time of signing.
